However, the storage period of the cookies created by us on your end device is also directly under your control. 4.5 When subscribing/unsubscribing & using our newsletter

Scope

We offer you the possibility to register voluntarily on our website for a free newsletter or to unsubscribe and we process the following personal data from you in doing so:

  • IP address
  • Action type (subscribe/unsubscribe)

In addition, we analyse the success and reach of our newsletters (campaigns). For example, after your registration we evaluate whether you open a newsletter or how you proceed with the newsletter.

4.6 When applying for our vacancies

Scope

With the help of the candidate management software from our external service provider HRworks GmbH (https://www.hrworks.de), we publish job offers on our website.

You can apply to us directly online in the job portal.
In addition, it is also possible to apply by letter or e-mail.
Every application (online in the job portal, by letter or by e-mail) that we receive is stored in the HRworks applicant management software and processed by us there.

Your personal data transmitted in connection with your application will be stored on a server of HRworks within the European Union and encrypted during transmission.

However, the responsible party within the meaning of Art. 4 No. 7 DSGVO is Esders GmbH because you are applying to us.

HRworks GmbH is a so-called application processor for us in accordance with Article 28 of the DSGVO.

We have concluded a corresponding application processing contract with HRworks GmbH in order to be able to guarantee the security of your personal data.

Should your application be rejected by our recruitment process, we also offer you the option of storing your personal data in a so-called “applicant pool”. This enables us to return to your application in case of new job offers and employee searches.

Purpose

Your personal data will be processed by us for the following purpose:

  • Selection of suitable applicants for positions to be filled by us
  • Establishment and maintenance of a database of potentially suitable applicants for positions to be filled in the future (so-called “applicant pool”)

Legal basis

Due to the following legal basis the processing of your personal data takes place by us:

  • Article 6 paragraph 1 letter b DSGVO – Due to (pre)contractual obligations

(Pre)contractual obligations result from the fact that an employment relationship can be established after a successful application process.

Our legitimate interest results from the necessity that we can prove that the respective selection procedure has been carried out in accordance with the German Gleichbehandlungsgesetz (Equal Treatment Act).

In addition, by giving your voluntary consent you can determine that your personal data will remain in our so-called “applicant pool” after unsuccessful selection procedures.

Storage period

Your personal data will be deleted 6 months after reaching the above mentioned purposes or by your withdrawal of your application. The period of 6 months results from our legitimate interest in being able to prove the legally compliant execution of the selection procedure in accordance with the German Gleichbehandlungsgesetz (Equal Treatment Act).

Your rights

You can withdraw your application at any time and you are not obliged to remain in our “applicant pool” after unsuccessful application. In addition, after your consent to remain in our “applicant pool”, you have the possibility to revoke your consent at any time (e.g. by email: datenschutz@esders.de).

4.7 By accessing our online presence in social networks

When you call up our online presence in social networks, your personal data is also processed by the respective provider. Please note that the exact scope, purpose, legal basis, storage period and your rights with regard to these processing operations of your personal data must also be taken from the details of the respective provider.

4.8 Through integration of third party services

Due to the integration of third-party services on our website, your personal data may be processed by the respective provider. Please note that you will then have to take the scope, purpose, legal basis, storage period and your rights regarding these processing operations of your personal data from the information of the respective provider.

4.9 Through the use of Esders IR / Esders LIVE

Scope

Esders-IR is a so-called “app” for transferring measurement data from Esders devices to an Android device. The subsequent transfer of the measurement data from the Android device to other devices (such as PCs etc.) can be done via email, various online storage services or with the help of Esders LIVE. Data forwarding via e-mail or online storage services can be selected directly in the app, but is not part of the app and must then be performed via the external program used in each case. Esders LIVE, on the other hand, is a paid online service that is integrated into the Esders IR App after activation. An Esders account is required to use Esders LIVE, which is specially designed for storing and processing measurement data from Esders devices. The transmission between Esders IR App and Esders LIVE is encrypted over the Internet and will not be passed on to third parties by us. For support purposes, however, our technicians can access your measurement data if required. Our servers, on which the measurement data is stored, are all located in Germany. In the Esders-IR App, the measurement data can then be downloaded again and documentation can be retrieved from the server. Esders LIVE sends a file to the Android device. This file depends on the type of documentation or report selected and contains free fields, checkboxes, etc. that can be user-defined. The collected data is sent back to the server and the finished test report can be downloaded. A printout from the Android device is also possible via a suitable Bluetooth printer.

Through the described use of our Esders IR App and through the use of Esders LIVE, the following personal data will be processed by us:

  • IP address of your android end-device
  • Person-related measurement data such as “inspector”
  • User name (only Esders LIVE)
  • Email address (only Esders LIVE)

  • Ensuring the smooth technical implementation of our service

Storage period

Individual data records are not deleted immediately when they are deleted, but are labeled as deleted. This is technically necessary to enable offline operation with synchronization. When the user account is deleted, it is actually deleted and not just labeled as deleted.

4.10 Through the use of Esders Pi-Note App / PC-Software

Scope

Esders Pi-Note is a so-called “app” for reading and extending measurement data from Esders devices. Esders PiNote consists of the Esders PiNote app, which is available free of charge in the Google Play Store, and the Esders PiNote PC software, which is subject to a charge. The Esders PiNote app is used to read out and expand measurement data from the Esders devices. With the Esders PiNote PC software, on the other hand, this measurement data can then be transferred from the Esders PiNote app to a PC.

The measurement data is continuously sent via a Bluetooth connection from the Esders device to the Android device and can be added to with GPS data of the route, photos, remarks, etc.. The route and the positions of data recordings and the exceeding of alarm thresholds are thus marked on a map on the Android device. In order to perform its functions, the app needs access to the following functions: Location (GPS), Bluetooth module, local memory. Both the use of the camera and the further processing of the data, e.g. sending by email or storage in an online memory, are offered as external functions, but they are not part of the app. Through the described use of the app the following personal data will be processed by us:

  • Location data
  • Person-related measurement data such as “inspector”

4.11 Through the use of Esders Pi NOTE Mobile Client / Analysis Client

Scope

Esders Pi NOTE is a GIS software and enables the recording, documentation & analysis of work for the inspection of buried gas pipelines. Esders Pi NOTE consists of a mobile client, which is used on site during the pipe network inspection, and an analysis client, which is used for the consolidation and processing of all data in the office.

The mobile client is installed on a toughpad or notebook and connected via Bluetooth to a suitable measuring device on site. This measuring device is then used to suck in and measure any escaping gases on the surface. An external GPS receiver for position determination can also be connected to the mobile client via Bluetooth. The route and positions of data recordings and alarm threshold crossings are recorded via GPS and marked on a map in Esders Pi NOTE. The map is based on the gas supply network, which is imported into the software beforehand.

The Analysis Client offers the additional functions of merging, processing, filtering and visualising all measurement data from several mobile clients. The installation takes place centrally on a server.

By using the Esders Pi NOTE Mobile Client & Analysis Client as described above, the following personal data will be processed by us:

Uninstalling the Esders Pi NOTE Mobile Client will delete the data from the local Windows PC.
Uninstalling the Esders Pi NOTE Analysis Client deletes the data from the server.

4.12 Through the use of Esders Connect

Scope

Esders Connect consists of the Esders Online Portal and the Esders Connect App.

The “Esders Connect Online Portal” can be accessed with any Internet-capable end device via one of the common browsers. It is a central and digital place for managing measurement data, measuring devices and orders (device, service & repair orders). In addition, device settings can be stored and changes made to reports, as well as product-specific documents (certificates, operating manuals, etc.) can be viewed & downloaded in the “Esders Connect Online Portal”. Registration as a user is required.

The “Esders Connect App” is the central link between the measuring devices and the “Esders Connect Online Portal”. The “Esders Connect App” is available in the Google Playstore for Android devices and in the Apple App Store for iOS devices. In addition, there is the “Esders Connect PC” software for use with a Windows phone or Windows PC. With the “Esders Connect App”, measurement data from supported devices can be uploaded to the “Esders Connect Online Portal” and reports can be sent to email addresses. In addition, updates & device settings can be downloaded to the supported devices via the “Esders Connect App”.

“Esders Connect” is hosted on our servers in Germany. Data is not passed on to third parties. Only data that is required to achieve the business objectives will be processed.

By using “Esders Connect” as described, the following personal data of you will be processed by us:

  • Your terminal device data (IP address etc.)
  • Your measurement data (test name, measurement location, date etc.)
  • Your user & contact data (name, e-mail address etc.)

Purpose

Your personal data will be processed by us for the following purpose:

  • Correct documentation of measurements and orders as well as administration of the devices.
  • Ensuring the smooth technical implementation of our service

Legal basis

We process your personal data on the following legal basis:

  • Article 6(1)(b) DSGVO – Due to (pre)contractual obligations.
  • Article 6(1)(f) DSGVO – On the basis of our legitimate interest.
    (Pre)contractual obligations arise from the fact that offers can be requested and orders placed via “Esders Connect”.

Our legitimate interest follows from ensuring the smooth technical implementation of our service.

4.13 By using our website through the software Mautic

Scope

This website uses the open source software Mautic for marketing automation. Marketing automation means that marketing measures are software-supported to be optimally aligned with the respective interests of each individual user. This is done by recording and analysing anonymous website visits and converting them into identified contacts with the help of input fields. Both anonymous and identified contacts can be divided into groups and assigned to different individualised marketing campaigns. These marketing campaigns are then used to provide the contacts with further information and promotional materials relevant to them.

Mautic is hosted on our servers in Germany. Data is not passed on to third parties. Only data that is required to achieve the business objectives is processed.

Through the described use of Mautic, the following personal data will be processed by us:

  • Your terminal data (IP address, web browser used, operating system, etc.)
  • Your activity data on the website (date, time & number of page views, length of stay, click path, downloads etc.)
  • Your user & contact data (name, email address etc.)
  • Your behavioural data for newsletters and email campaigns (opens, clicks on links etc.)
